Welcome to Aamya. These Terms and Conditions (“Terms“) are a binding agreement between you (“User“, “you“, “your“) and Healthpresso Private Limited (“Aamya“, “we“, “us“, “our“), a company incorporated under the Companies Act, 2013 (CIN: U86909DC2026PTC473476), with its registered office at B3/71, Rajasthali Apartments, Pitampura, Saraswati Vihar, North West Delhi – 110034, Delhi, India.

 

These Terms, together with our Privacy Policy, Telehealth & Data Processing Consent Notice, Refund Policy, and Cancellation Policy (collectively, the “Policies”), govern your access to and use of aamya.com, our app (if any), our WhatsApp channels, and all related services (together, the “Platform“). By creating an account, booking a consultation, checking a consent box, or otherwise using the Platform, you agree to be bound by these Terms and the Policies. If you do not agree, do not use the Platform.

1. Eligibility

By using the Platform, you represent and warrant that you:

  • are at least 18 years of age;
  • are a resident of India, physically located in India at the time of any consultation;
  • are legally competent to enter into a binding contract under the Indian Contract Act, 1872;
  • are not prohibited by any applicable law from using the Platform; and
  • meet the medical eligibility criteria for Aamya’s programs, as determined through onboarding questionnaires, medical history review, diagnostics, and consultation with a doctor. 

Aamya’s programs are designed for women. We may decline, pause, or discontinue services to any individual based on clinical judgment or program eligibility criteria, at our discretion or that of the treating doctor.

2. Nature of Our Services — Aamya as a Platform Facilitator

2.1 Aamya operates a technology platform that connects you with independent, registered medical practitioners (“RMPs”), nutritionists, and health coaches (together, your “Care Team“), and facilitates access to third-party diagnostic laboratories and pharmacies. Aamya, as a corporate entity, does not practice medicine and does not itself diagnose, treat, or prescribe.

2.2 The doctor-patient relationship is established directly between you and the treating RMP, in accordance with the Telemedicine Practice Guidelines, 2020. Aamya is not a party to that clinical relationship and does not control or interfere with the independent clinical judgment of any RMP. Nutritionists and health coaches provide guidance strictly within their own professional, non-medical scope.

2.3 We are not a pharmacy. Aamya does not manufacture, stock, sell, or dispense medication, including GLP-1/GIP therapies. Any prescription is the independent decision of your treating doctor, and you are responsible for purchasing prescribed medication from a licensed pharmacy of your choice, at your own cost.

2.4 Diagnostic tests and, where offered, at-home sample collection, are provided by independent third-party laboratory partners, who are solely responsible for accuracy of collection and testing. Aamya facilitates scheduling but does not perform these services itself.

2.5 User-Provided Information: Your Care Team’s advice depends entirely on the accuracy of the information you provide, including information shared orally during calls or WhatsApp conversations, which Aamya may not always record. You are solely responsible for the truthfulness, accuracy, and completeness of information you share, whether in writing or orally, and Aamya is not liable for adverse outcomes resulting from information you provided that was incomplete, inaccurate, or misleading.

2.6 No Guarantee of Outcomes: Weight-loss outcomes, timelines, and testimonials referenced on the Platform are illustrative only. Individual results vary based on numerous factors outside Aamya’s control, and Aamya makes no warranty or guarantee of any specific health outcome.

3. Medical Emergency and Scope Disclaimer

The Platform and Care Team are not designed or intended for medical emergencies or urgent health situations. If you experience chest pain, difficulty breathing, sudden severe headache, loss of consciousness, signs of a stroke, severe allergic reaction, uncontrolled bleeding, or any other acute or life-threatening symptom, call 108 or 112, or go to the nearest hospital or emergency room immediately. Do not wait for a response from the Platform or your Care Team. Aamya expressly disclaims responsibility for any adverse outcome resulting from a failure to seek immediate emergency care.

 

In some cases, your doctor may determine that your condition requires an in-person visit, a specialist, or care beyond what telemedicine can appropriately provide. In such cases you will be informed and guided on next steps; Aamya is not liable for conditions that are not appropriately addressed through telemedicine.

4. Financial Responsibility — Cash Basis, Not Insurance

Aamya’s programs and consultation fees are not covered by any government health scheme or, typically, by private health insurance, and Aamya does not submit claims to any insurer or government payer on your behalf. You are choosing to obtain these services on a cash-payment basis and are solely responsible for the costs of the program. Whether your specific insurance policy separately reimburses any portion of these costs is a matter between you and your insurer; please check with them directly if relevant.

5. Medical Eligibility, Contraindications, and Prescription Medication

5.1 Contraindications: Certain pre-existing conditions or factors — including but not limited to Type 1 diabetes, a personal or family history of medullary thyroid carcinoma or Multiple Endocrine Neoplasia syndrome type 2 (MEN 2), a history of pancreatitis, severe renal impairment, active eating disorders, pregnancy, planning pregnancy, or breastfeeding — may make you ineligible for GLP-1/GIP therapy or other components of the program. Final eligibility for any prescription is determined solely by the clinical judgment of your treating doctor, not by Aamya.

5.2 Doctor’s Responsibility: Your treating doctor is solely responsible for explaining, before prescribing, the nature and purpose of any medication, its expected benefits, common and serious side effects, alternatives, dosage and administration instructions, what to do if a dose is missed, known contraindications and drug interactions, and whether any use is “off-label.” You must give your informed consent directly to your doctor before any medication is prescribed; this is separate from your acceptance of these Terms.

5.3 Reporting Side Effects: You agree to promptly and accurately report any side effects or adverse reactions to your treating doctor or Care Team. Timely reporting is critical to your safety.

5.4 Adherence: You are solely responsible for taking any prescribed medication exactly as directed by your doctor. Aamya may provide reminders as a convenience but does not guarantee adherence and is not responsible for consequences of non-adherence.

6. Authorization to Facilitate Diagnostics and Medication Orders

By accepting these Terms, you provide limited, revocable authorization to Aamya, for the duration of your active program, to:

  • schedule and coordinate diagnostic tests with our third-party laboratory partners on your behalf; and
  • transmit your e-prescription, along with necessary contact and delivery details, to a licensed pharmacy of your choice or a partner pharmacy, to facilitate your purchase of prescribed medication.

This includes your consent for Aamya to share necessary personal and health information (name, contact details, test requisitions, e-prescriptions) with these third parties solely for the purpose of arranging your tests or medication. Laboratories and pharmacies are independent entities solely responsible for their own services, accuracy, and data practices; Aamya is not liable for their acts or omissions, though we will assist in good faith to resolve issues you raise.

7. Consent to Telehealth

Your use of the Platform requires your review and acceptance of our separate Telehealth & Data Processing Consent Notice, which explains the nature, benefits, and limitations of telemedicine, and your specific consent to receiving care via teleconsultation. You may withdraw consent to teleconsultation at any time, but doing so will likely prevent Aamya from continuing to provide you services, as teleconsultation is a core and indispensable part of how care is delivered.

8. Subscription Fees, Program Pricing, and Payment

8.1 Access to Aamya’s programs requires payment of the applicable program/consultation fee, quoted in Indian Rupees and inclusive of applicable GST unless stated otherwise. You authorize Aamya and its third-party payment processors (e.g., Razorpay or a similar payment gateway) to charge your chosen payment method.

8.2 The program fee does not include the cost of any prescription medication, which you pay for separately and directly to your chosen pharmacy.

8.3 If your program involves recurring or subscription-style billing (e.g., monthly check-ins), the billing cadence, renewal terms, and how to cancel will be clearly communicated to you at the time of purchase and are also governed by our Cancellation Policy.

8.4 We may change our program fees or structure from time to time; we will give you reasonable advance notice of any change affecting an active subscription before it next renews.

8.5 Refunds and cancellations are governed by our separate Refund Policy and Cancellation Policy.

9. Your Account

You agree to provide accurate, current, and complete information and to keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at hello@aamya.com of any suspected unauthorized use. You may maintain only one account for personal use.

10. Intellectual Property and User Content

10.1  All content on the Platform — including the Aamya name and logo, trademarks, text, graphics, program design, and personalized diet/exercise plans — is owned by or licensed to Healthpresso Private Limited. You receive a limited, non-exclusive, non-transferable, revocable license to use the Platform for your personal, non-commercial use.

10.2  Any content you submit (meal logs, messages, feedback, testimonials) (“User Content“) remains yours, but you grant Aamya a non-exclusive, royalty-free license to use it to operate and improve the Platform and, only with your specific consent, to use anonymized testimonials for marketing.

11. Prohibited Conduct

You agree not to: violate any applicable law; infringe Aamya’s or any third party’s intellectual property or other rights; upload viruses, malware, or harmful code; attempt to hack, overload, or disrupt the Platform or probe its security; use bots, scrapers, or automated tools to access or extract Platform content; reverse-engineer, decompile, or attempt to extract source code; impersonate any person or misrepresent your identity or affiliation; create multiple or shared accounts; harass, defame, or transmit obscene, unlawful, or fraudulent content; attempt to obtain prescription medication under false pretences or for resale; or use the Platform for any purpose other than its intended use.

We may suspend or terminate access for any breach of this section, without prior notice, and may cooperate with law enforcement where a criminal violation is suspected.

12. Intermediary Status

To the extent Aamya’s Platform functions as an intermediary under the Information Technology Act, 2000, transmitting information provided by third parties (including Care Team communications), Aamya observes due diligence in accordance with applicable intermediary guidelines and does not select or modify third-party content that passes through the Platform.

13. Disclaimers

The Platform and its content are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Aamya disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, and does not warrant that the Platform will be uninterrupted, error-free, or free of harmful components. Content on the Platform (educational material, general wellness information) is for informational purposes only and does not substitute individualized medical advice from your treating doctor.

14. Limitation of Liability

To the fullest extent permitted by law, Aamya, its directors, employees, and affiliated Care Team members shall not be liable for indirect, incidental, special, or consequential damages, including loss of profits, data, or goodwill, arising from your use of the Platform. Aamya’s aggregate liability for any claim shall not exceed the total amount you paid to Aamya for the specific service giving rise to the claim, or ₹10,000, whichever is higher. Nothing in this clause limits liability that cannot be excluded under Indian law, including liability arising from proven negligence causing death or personal injury.

15. Indemnification

You agree to indemnify and hold harmless Healthpresso Private Limited, its directors, employees, and affiliated Care Team members from claims, losses, or costs (including reasonable legal fees) arising from your breach of these Terms, your provision of false or misleading information, your misuse of prescribed medication, or your violation of applicable law or third-party rights.

16. Termination

We may suspend or terminate your access at our discretion, including for breach of these Terms, safety concerns identified by a Care Team member, non-payment, or misuse. You may stop using the Platform at any time. Provisions relating to intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution survive termination. Outstanding payments become due immediately upon termination.

17. Force Majeure

Neither party will be liable for delay or failure to perform obligations under these Terms where such delay or failure results from circumstances beyond that party’s reasonable control, including acts of God, pandemic, fire, flood, natural disaster, strikes, war, terrorism, or civil unrest.

18. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified via the Platform, email, or WhatsApp, along with an updated “Last updated” date. Continued use after changes take effect constitutes your acceptance of the revised Terms.

19. Governing Law and Dispute Resolution

19.1 These Terms are governed by the laws of India.

19.2 If a dispute arises, you agree to first attempt to resolve it amicably with us through good-faith discussion for at least 30 days before initiating any formal proceeding.

19.3 Subject to Clause 19.2 and Clause 20 (Grievance Redressal), any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts at Delhi, India.

20. Grievance Redressal

In accordance with the Information Technology Act, 2000 and the Consumer Protection (E-Commerce) Rules, 2020, you may reach our Grievance Officer with any complaint:

We aim to acknowledge complaints within 2 business days and resolve them within the timelines required under applicable law.

21. Miscellaneous

  • Entire Agreement: These Terms, together with our Policies, form the entire agreement between you and Aamya regarding the Platform.
  • Severability: If any provision is found unenforceable, the remainder of these Terms remains in effect.
  • No Waiver: Our failure to enforce any provision is not a waiver of our right to do so later.
  • Assignment: You may not assign these Terms without our written consent. We may assign or transfer these Terms in connection with a merger, acquisition, or sale of assets.
  • No Agency: Nothing in these Terms creates a partnership, joint venture, or employment relationship between you and Aamya or any Care Team member.
  • Notices: We may provide notices via email, WhatsApp, or posting on the Platform.
