This Consent Notice is provided by Healthpresso Private Limited, operating as Aamya (“Aamya”, “we”, “us”), and should be read together with our Terms and Conditions and Privacy Policy. It is intended to be presented for your affirmative acceptance (e.g., via a checkbox) during onboarding, separately from general acceptance of our Terms, in line with the informed-consent requirements of the Telemedicine Practice Guidelines, 2020.

1. Consent to Telehealth Consultation

Telemedicine involves the delivery of healthcare using electronic communication (video, audio, or chat) between you and a healthcare provider who is not in the same physical location as you. By accepting this Notice, you explicitly consent to receiving consultations, advice, and care from Aamya’s affiliated doctors, nutritionists, and health coaches via teleconsultation.

You understand and acknowledge that:

  • Teleconsultation offers benefits such as convenience and improved access to care, but also has inherent limitations, including the absence of a direct physical examination, which may constrain a doctor’s diagnostic ability for certain conditions;
  • Technical issues (connectivity failures, delays) may occasionally affect a consultation;
  • Teleconsultations will be conducted in accordance with the Telemedicine Practice Guidelines, 2020;
  • You may withdraw this consent at any time by writing to hello@aamya.com — however, since teleconsultation is the core method by which Aamya delivers care, withdrawing consent will likely mean Aamya can no longer continue providing you services.

2. Understanding Prescription Medication (Including GLP-1/GIP Therapy)

You acknowledge that Aamya’s program is medically supervised, and that a prescription — including for GLP-1/GIP medication — is issued only if your treating doctor independently determines it is clinically appropriate for you, following a comprehensive assessment. You understand that:

  • Your doctor is responsible for explaining the medication’s purpose, expected benefits, common and serious side effects, alternatives, dosage, administration, and what to do if you miss a dose, before prescribing;
  • You must give your own informed consent directly to your doctor before any medication is prescribed or treatment begins — this is separate from, and in addition to, your acceptance of this Notice;
  • You are responsible for reporting any side effects promptly to your Care Team; and
  • Aamya does not sell, dispense, or guarantee the availability of any medication — you purchase prescribed medication separately from a licensed pharmacy.

 

3. Consent to Data Collection and Use

You explicitly consent to Aamya collecting and processing the following categories of your personal data for the purposes of providing your care:

  • Identity and contact details (name, phone, email, address);
  • Medical history, current conditions, medications, allergies, and contraindication screening responses;
  • Consultation notes, assessments, diet/exercise plans, and prescriptions generated by your Care Team;
  • Diagnostic test results shared by laboratory partners;
  • Payment and transaction details;
  • Information you provide orally over calls or WhatsApp, which may not always be recorded (see Section 5); and
  • Technical/usage data from your use of the Platform.

4.Consent to Facilitation of Diagnostics and Medication Orders

You provide specific, one-time authorization, for the duration of your active program, for Aamya to:

  • share relevant personal and health information (name, contact details, test requisition details) with our third-party laboratory partners, to schedule and coordinate your diagnostic tests; and
  • share your e-prescription and delivery details with a licensed pharmacy of your choice or a partner pharmacy, to facilitate ordering and delivery of medication prescribed to you.

You understand that laboratories and pharmacies are independent third parties, responsible for their own services and data practices, and that Aamya facilitates but does not perform these services itself.

5. Accuracy of Information You Provide, Including Orally

You agree that information you share with Aamya’s team or your Care Team — whether in writing or orally over a call — will be accurate, complete, and truthful to the best of your knowledge. You understand that calls may not always be recorded, that your Care Team relies on their good-faith understanding of what you communicate, and that Aamya is not responsible for adverse outcomes resulting from information you provided that was incomplete, inaccurate, or misleading.

6. Recorded Consultations (If Applicable)

If Aamya records any audio or video consultation, this will only happen with your separate, explicit consent obtained before that specific session begins. You may decline recording; where medically feasible, we will offer an unrecorded alternative. Recordings, where made, are used only for continuity of care, safety supervision, quality assurance, or legal/regulatory compliance, and are stored securely with access limited to authorized personnel.

7. This Platform Is Not for Emergencies

You understand and agree that Aamya is not designed or intended for medical emergencies. If you experience a medical emergency, you must call 108 or 112, or go to the nearest hospital immediately — do not rely on the Platform or Care Team for urgent or emergency needs.

8. Your Role in Program Success

You understand that the safety and effectiveness of your program depends significantly on your active participation — providing accurate information, attending scheduled consultations, reporting side effects promptly, and following your Care Team’s guidance.

9. Withdrawing Consent

You may withdraw any consent given in this Notice at any time by writing to hello@aamya.com. We will stop the relevant processing upon withdrawal, except where we are required by law to retain or share certain data (for example, medical record-keeping obligations or a government/regulatory request). Withdrawing consent to teleconsultation or to data processing necessary for clinical care will likely mean we can no longer continue providing you services.

10. Your Rights

You have rights under the Digital Personal Data Protection Act, 2023, including the right to access, correct, or erase your personal data; to nominate another individual to exercise your rights in the event of your death or incapacity; to withdraw consent as easily as you gave it; and to escalate unresolved grievances to the Data Protection Board of India. 11. Your Confirmation

By accepting this Notice, you confirm that:

  • You are at least 18 years old and are a resident of India;
  • You have read and understood this Notice, our Terms and Conditions, and our Privacy Policy; and
  • You give your informed, voluntary consent as described above.
